Contributions plans

Section 7.11 and 7.12 (and former s94) of the Environmental Planning and Assessment Act 1979 and Section 64 of the Local Government Act 1993 enables Councils in New South Wales to levy contributions on a development where that development generates an increased demand on Council's services and facilities. 

This is intended to ensure that the existing ratepayers are not required to meet the whole cost of providing new infrastructure in the Local Government Area. 

Contributions including monetary payments, works in kind or works as part of a Voluntary Planning Agreement (VPA), are made to Council to upgrade infrastructure and facilities to cater for demand generated by development. Larger scale developments may also need to dedicate land to Council for open space and/or other facilities.

Contributions and Development Servicing Plans help fund local infrastructure provision and embellishment of local roads, footpaths, public open space, community facilities, stormwater drainage, water supply, sewerage headworks and roads impacted by heavy vehicles.

Clarence Valley Local Infrastructure Contributions Plan 2025

Council adopted the Clarence Valley Local Infrastructure Contributions Plan 2025 at the September 2025 Ordinary Council Meeting (Item Reference Number 2025.1940).

The Contributions Plan 2025 commenced on 1 November 2025, and repeals fourteen (14) Contributions Plans.

Extractive Industry and Heavy Haulage Plans

The following Extractive Industry and Heavy Haulage Plans established under the former section 94 (EP&A Act) remain in force and were not repealed by the Contributions Plan 2025.

Sewer and Water Development Servicing Plans (Section 64 Plans)

At its meeting of 18 June 2026 Council adopted Sewer and Water Development Servicing Plans (DSP), which commence on 1 July 2026.

The DSPs cover the water and sewer developer charges levied under section 64 of the Local Government Act 1993 (LG Act) for the development areas served by Clarence Valley Council as indicated in the plans.

Repealed Contributions Plans

The Clarence Valley Local Infrastructure Contributions Plan 2025 repealed fourteen (14) Contribution Plans, including Clarence Valley Contributions Plan 2011 and thirteen (13) plans from the former Council’s prior to the amalgamation to form Clarence Valley Council.

The repealed plans have been removed from Council’s website. You can access the repealed plans by submitting a Request for Information, which is offered free of charge.
